This Privacy Notice describes how FarmOp Capital (“FarmOp,” “we,” “our,” or “us”) collects, uses, and discloses personal information about you when you use, create an account, and/or apply for a commercial loan on our portal, (“Portal”). Personal information is sometimes also referred to as personal data, personally identifiable information, or other like terms that mean any information that directly or indirectly identifies you or is reasonably capable of being associated with you. We may provide different or additional notices of our privacy practices with respect to our personal information collection as necessary or required by law. Please note that the Portal is intended for persons engaging us for commercial purposes, and not for consumers acting in an individual or household context.

We may change this Privacy Notice from time to time. If we make changes, we will notify you by revising the date at the top of this Privacy Notice. We encourage you to review this Privacy Notice regularly to stay informed about our personal information practices and the choices available to you.

1. Personal Information Collected

A. Personal Information You Provide On The Portal

When you use the Portal, we collect personal information that you voluntarily provide, such as when you apply for a commercial farm loan or related services. The personal information we may collect includes:

  1. Identifiers, such as login credentials on the Portal, name, phone number, email address, address, Social Security number, driver’s license number, state identification card number, bank account number, signature, citizenship status, date of birth, and marital status.

  2. Information about your business and experience, such as legal entity name, state of formation, owner and ownership percentage, Tax Identification Number, years of farming and farm management experience, property information, farm income, information related to projected income, and additional sources of income.

  3. Loan information, such as type of loan you are interested in and loan amount.

  4. Insurance, such as information about your insurance coverage, documents, policy number, and agent.

  5. Credit information, such as unsatisfied judgments against applicant, bankruptcy, past due status, property foreclosed or transferred deed in lieu, other debts, payment obligations and lenders, eligibility for certain programs, and other applicant information.

B. Personal Information We Collect Automatically

We may automatically collect certain personal information about your interaction with us on the Portal. This includes how you access the Portal, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, unique device identifiers, browser type, and app version. We also collect information about your activity on our Portal, such as access times, pages viewed, links clicked, and the page you visited before navigating to the Portal.

C. Personal Information We Collect From Other Sources

We may obtain personal information about you from other sources, such as third parties and consumer reporting agencies.

D. Personal Information We Derive

We may derive personal information or draw inferences about your eligibility for a commercial farm loan based on the information we collect.

2. Purpose and Use of Personal Information

We may use the categories of personal information identified above for the following purposes:

  1. Assess your eligibility and provide commercial farm loans;

  2. Provide, maintain, and improve our products and services, including the Portal;

  3. Send you technical notices, security alerts, and support and administration messages;

  4. Respond to your comments and questions and provide customer service;

  5. Communicate with you about products, services, and events offered by FarmOp;

  6. Monitor and analyze trends, usage, and activities on the Portal;

  7. Detect, investigate, and prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity and protect the rights and property of FarmOp and others;

  8. Debug to identify and repair errors in our services;

  9. Comply with our legal and financial obligations; and

  10. Carry out any other purpose described to you at the time the information was collected.

3. Disclosure of Personal Information

We may disclose your personal information under the following circumstances:

  1. We may disclose personal information with our service providers, contractors, or processors who provide services to FarmOp, such as IT, software, web hosting, cloud storage, and platform services;

  2. We may disclose personal information if we believe that the disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements. We may also disclose personal information if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of FarmOp, our users, the public, or others;

  3. We may disclose personal information with our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests;

  4. We may disclose personal information in connection with, or during negotiations concerning, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company;

  5. We may disclose personal information between and among FarmOp and our current and future parents, affiliates, and subsidiaries; and

  6. We may disclose personal information with your consent or at your direction.

  7. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4. Retention of Personal Information

We store personal information for as long as necessary to carry out the purposes for which we originally collected it and for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations.

5. Children

Our Portal is not intended for or directed at children under the age of 18. In addition, we do not knowingly collect personal information from children under the age of 18.

6. Your Choices

You may contact us at hello@farmop.com or 30 E 7TH STREET, SUITE 2400, ST PAUL, MN 55101 if you would like to exercise certain actions in connection with your personal information, such as to access, delete, or correct your personal information. If we receive such a request, we will initially verify your identity by asking you to provide personal information related to your interactions with us. We will then consider your request as required or permitted by law or as necessary to provide our services. Please note that if you are an authorized agent with legal authority to act on behalf of another person or a business, we will require documentation confirming your authority to act. We will not discriminate against you for exercising these options related to your personal information.

7. “Do Not Track” Requests

Some browsers have incorporated “Do Not Track” features. Most of these features, when turned on, send a signal or preference to the websites you visit indicating that you do not wish to be tracked. Because there is not yet a common understanding of how to interpret the do not track signal, we currently do not respond to browser do not track signals.

8. Transfers of Information to the United States

FarmOp is headquartered in the United States, and we may have operations and service providers in the United States and other countries. Therefore, we and our service providers may transfer your personal information to, or store or access it in, jurisdictions that may not provide levels of data protection that are equivalent to those of your home jurisdiction.
